This study includes an analytical study of the term "Qiyās al-Adna” among the Scholars of Uṣūl al-Fiqh. It is known that the Qiyās is divided into the following types: an analogy of higher order (Qiyās al-Awla), an analogy of an equivalent order (Qiyās al-Musawi), an analogy of a lower order (Qiyās al-Adna). However, Qiyās al-Adna raised issues and objections among some scholars, in past and present; hence, there is an urgent need to present a comprehensive study that shows the meaning (...) of Qiyās al-Adna for those who advocate it, discusses the objections and issues that have been raised about it, and clarifies its connection to other Qiyās types. Moreover, the study will concern the applied side of Qiyās al-Adna by explaining how jurists used it. The researcher used the analytical method and referred to the most important, ancient and modern Uṣūl al-Fiqh sources and references. The study concluded with results, the most prominent of which is that the Qiyās al-Adna has two meaning: the first is that in which the original case is more deserving of legal ruling than the new or parallel case, so the new case is considered as a lower order, and the second is that the effective cause in the new case is weaker than in the original case. Among the results of the study is that the objections directed to the Qiyās al-Adna are weak, and that it is not limited to the presumptive Qiyās on the most correct opinion, also, that the jurists used the term Qiyās al-Adna in the second meaning, which says that the lower order is in its effective cause, not the legal ruling. It is well known in the usûl al-fiqh (fundamental principles of Islamic law) that the Mukallaf (accountable person) is either a Mujtahid or a Muqallid. Mujtahid is a title given to the Islamic jurist who has the ability to arrive at rulings; thus, he is required to practice Ijtihad. While Muqallid is the person who has no ability to conduct such activities; thus, he is required to follow the Mujtahids. Taqlid (conformity of one person to the ijtihad of another) of (...) the four Imams has been common among Muslims since the fourth century of the hijri, their madhhabs including its origins and branches have been well established, and many scholars and laypersons have followed them since that era till the time being. The second considers that restricting imitation (Taqlid) to these schools of thought has caused the stagnation of Islamic jurisprudence and its inability to keep pace with the times. The research dealt with these two points of view and followed the method of comparison and analysis. The two points of view on the issue were presented and discussed, and then the implications in contemporary reality were explained. The research used books written in the science of jurisprudence in general and in the section of Juristic Interpretation and Imitation in particular, in addition to books written in the history of jurisprudence. The research reached several results, most notably are as follow: 1) the need to adhere to the four schools of thought (Madhhabs) in all actions and fatwas and not to depart from them except for necessity and need, 2) these Madhhabs represent the jurisprudential identity of the Sunnis group, it should not be underestimated, and that it is sufficient to meet most of the needs of the age. It is not correct to describe the commitment to it as inertia. The call for liberation from the jurisdiction of the four schools of thought resulted in corruption, the most important of which is the lack of discipline in fatwas and providing fatwas with abnormal sayings. Este artículo estudia dos aspectos primordiales del cadiazgo de la ciudad de granada bajo los almorávides. Por un lado, expone la lista de los cadíes de Granada basándose en los datos proporcionados por las fuentes biográficas andalusíes. Por el otro, analiza los mecanismos de la relación entre el poder político almorávide y la élite local granadina, relación que se caracterizó, en gran medida, por la negociación y el enfrentamiento. El cadiazgo de Granada fue gestionado por varias familias andalusíes, granadinas y (...) no granadinas, y no por voluntad propia de los granadinos, sino por imposición de las autoridades almorávides. También, encontramos miembros de familias magrebíes ocupando el cadiazgo en mayor número del atestiguado al mismo tiempo en otras ciudades andalusíes ¿no se incluye a Algeciras por razones ligadas especialmente al estatuto de la ciudad¿. Con esto, las autoridades almorávides querían evitar el monopolio de las funciones judiciales por parte de la élite local, y con ello ejercer mayor control sobre la ciudad, sobre todo teniendo en cuenta que era la capital andalusí. We study the effects of density dependent migrations on the stability of a predator-prey model in a patchy environment which is composed with two sites connected by migration. The two patches are different. On the first patch, preys can find resource but can be captured by predators. The second patch is a refuge for the prey and thus predators do not have access to this patch. We assume a repulsive effect of predator on prey on the resource patch. Therefore, when (...) the predator density is large on that patch, preys are more likely to leave it to return to the refuge. We consider two models. In the first model, preys leave the refuge to go to the resource patch at constant migration rates. In the second model, preys are assumed to be in competition for the resource and leave the refuge to the resource patch according to the prey density. We assume two different time scales, a fast time scale for migration and a slow time scale for population growth, mortality and predation. We take advantage of the two time scales to apply aggregation of variables methods and to obtain a reduced model governing the total prey and predator densities. In the case of the first model, we show that the repulsive effect of predator on prey has a stabilizing effect on the predator-prey community. In the case of the second model, we show that there exists a window for the prey proportion on the resource patch to ensure stability. (shrink)

In this article, we try to study Clark Pinnock’s point of view in explaining the methodological foundations of the Open Theism Theory with a descriptive-analytical method so that we can have a fair critique of the strengths and weaknesses of this theory while also understanding it correctly. Pinnock can be considered one of the most important theorists and founders of Open Theism. In his view, Open Theism is one of the theological-philosophical theories that have emerged in the critique of the (...) teachings of traditional Christian theology and consider its claims to be logically and narratively contradictory. Pinnock believes that open theists sanctify God as acknowledged in the Bible and that some of the attributes of God in traditional theology should be revised and modified based on the text of the Bible. They believe that God is the God of the Bible; someone who is truly connected to the world, a relationship that requires the most mobility, not immobility. In this view, God is portrayed as a triune relationship-oriented truth, which seeks romantic relationships with human beings and thereby grants them true freedom. Finally, since open theists believe that theology should be understood by the people of the present age, a better explanation of theology depends on reliance on modern philosophy and its effects. In modern philosophy, method and methodology have become very important. In general, methodology is the knowledge that recognizes “how to go” and the fundamental methodology reveals the hidden principles of each theory and creates the basis for its basic critique. Of course, the purpose of this article is specifically to examine the “basics” of Pinnacle’s method, not his “method.” In fact, the report presented by his method is a platform for examining the basics. From the author’s point of view, most of the mistakes that have been made in traditional theology are also reflected in Open Theism; leading in another way! That is to say, most of the objections that Pinnock made to traditional theologians also apply to him. For example, why is it bad to be influenced by Greek philosophy, but Open Theism’s claims can be influenced by modern philosophy? Do ancient philosophy and modern philosophy have precise and acceptable boundaries at all? On what basis do open theists claim that modern philosophy is more acceptable to modern people than ancient philosophy? Can mere simultaneity justify it? If we take as a basis the claim of open theists – that every thought comes “from somewhere” and that no thought is pristine – the encounter of open theists with the text of the Bible is also done with the presuppositions of modern philosophy, and their pivotal mindset has influenced their understanding of the Bible. How can one be sure that the path taken by theology is more correct than the path taken by its predecessors? Since a better understanding of each theory is gained by reflecting on its foundations, in this article we intend to examine the methodological foundations of Open Theism by looking at the book Most Moved Mover. In general, from Pinnock’s point of view, the method of open theism can be based on the three main bases of the critical study of the interpretation of traditional theologians, return to the Bible and overcoming Hellenism, and attention to modern philosophy, which we will describe and critique. Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

Cet article traite de la norme de disponibilité induite par une temporalité marchande et des résistances des employés à une flexibilité maximale. Il s’appuie sur une enquête dans des réseaux de boutiques en France et en Belgique. Nous étudions les principes d’organisation marchande au travers des pratiques managériales d’adaptation au flux marchand et de mise en subordination des salariés par les durées d’emploi. Les enseignes de mode (prêt-à-porter) façonnent un temps marchand dont la rentabilité provient de la concordance entre temps (...) de travail et temps de consommation. L’organisation productive de ces enseignes conduit à placer les managers responsables de ces boutiques dans une fonction de maximisation de la rentabilité des points de vente et à exiger du personnel une disponibilité temporelle flexible. Il en résulte de fortes pressions sur une temporalité personnelle de moins en moins autonome (désarticulations temporelles) mais aussi une opposition à une dépendance permanente au temps imprévisible de la boutique. Cette variabilité du temps de travail entraîne des conduites d’indisponibilité et de défense d’une autonomie temporelle contre le temps marchand. Les résistances ont lieu lors de changements arbitraires des jours de travail ou des horaires ; elles peuvent conduire au refus d’heures supplémentaires ou de passer à temps complet certains mois de l’année. The term ‘Holy Spirit’ is referenced four times in the Quran, with three instances directly related to Jesus Christ, while the broader term ‘spirit’ or “the spirit” (al-Rūḥ) appears eighteen times, some of which pertain to Mary, the mother of Jesus. This study explores the concepts of the Spirit and Holy Spirit as they are presented in the Quran, as well as their interpretations in classical Islamic exegesis. The research begins by analyzing the Quranic verses where the “Holy Spirit” is (...) associated with Jesus Christ and his mother, providing a detailed examination of these occurrences and their contextual significance. Subsequently, the study delves into the instances of the “Holy Spirit” in other contexts, offering a comparative analysis of the term’s usage across different passages. Following the discussion on the “Holy Spirit,” the study shifts focus to the discussion of “the spirit” (al-Rūḥ) and “a spirit” (Rūḥ) in the Quran. Adopting the same methodological approach, it first addresses the verses connected to Jesus and Mary, before exploring the diverse contexts in which the spirit is mentioned. In each case, the relevant Quranic interpretations are discussed, drawing from key Quranic commentaries (tafsīr). The study relies on a combination of classical exegetical methods, incorporating both narration-based exegesis (tafsīr bi-l-ma'thūr), such as the works of al-Ṭabarī and al-Baghawī, and reasoning-based exegesis (tafsīr bi-l-ra'y), as exemplified by the works of Imām Fakhr al-Dīn al-Rāzī. Additionally, it evaluates the authenticity and sources of the exegetes’ interpretations, scrutinizing their reliance on prophetic traditions (hadith), the explanations of the Prophet’s companions, and even biblical sources. By presenting and comparing a range of Quranic interpretations, this study aims to highlight the diversity of thought surrounding the concepts of the ‘Spirit’ and ‘Holy Spirit’ within Islamic tradition. It provides a valuable resource for those seeking to understand how these notions are interpreted and debated within Islam and offers a platform for comparison with the corresponding concepts in Christianity and Judaism, thereby contributing to broader interfaith theological dialogues. Our research is in the perspective of intercultural psychology and addresses the question of memories an intercultural situation leaves for individuals who experience it during their life. More precisely, it is through the autobiographical memory that our research analyzes the articulation between identity and memory processes in relation to a life experience in an intercultural situation, whether it is a life in a multicultural environment, a migration towards a new cultural environment, a plurality of cultural affiliations or many other configurations (...) that the present world is filled with and for which the cultures contact is put in the foreground. The autobiographical memory retains representations of our past and plays a fundamental role in building a sense of identity and continuity of existence. Our article presents results from an analysis based on the life stories of 5 elderly subjects who had intercultural experiences. It would seem that early intercultural experience directs life discourse towards a principle of coherence in autobiographical memory, emphasizing what the participant was rather than what he achieved. On the other hand, Late intercultural experience orients it to a correspondence principle in autobiographical memory, attaching to actions and temporality of life experience and highlighting achievements rather than individuals self perception. Ethnicity and International Law presents an historical account of the impact of ethnicity on the making of international law. The development of international law since the nineteenth century is characterised by the inherent tension between the liberal and conservative traditions of dealing with what might be termed the 'problem' of ethnicity. The present-day hesitancy of liberal international law to engage with ethnicity in ethnic conflicts and ethnic minorities has its roots in these conflicting philosophical traditions. In this paper I intend to examine the notion of intermediate in Plato´s dialogues, especially Theaetetus and Symposium. In the first section, I investigate previously in Theaetetus the notion of to metaxy as the result of mixture between percipient and perceived, by which the realm of phenomenon can be explained by the third genre, identified as to metaxy, born from a certain kind of dynamis. In the second section, I examine the mentioned notion s Symposium, expressed by Diotima of Mantineia (...) on her encomium of Eros as daimon. My purpose in this last section is to demonstrate that the apprehension of Form of Beauty itself requires a new hermeneutic approach, which I call cultual hermeneutic, by which Plato conceives an inherent link between mythical and rational conceptions of Ideas. Citation can be classified in three categories: optional; semi-mandatory; and mandatory. There are some negative and positive impacts for the authors’ paper and journals’ reputation if mandatory citation of a paper or set of papers is requested. These effects can be different based on the recommended papers for citing in the new research. Mandatory citation has various types discussed in this paper. In the medieval Bengal, Hindus and Muslims lived in a society where mainly the religion controlled foremost aspects of life. In this context, both the communities maintained two distinct educational systems in Bengal. This paper attempts to present the emergence of Islamic education in Bengal during Sultanate period and its development in relation to the indigenous education of the Hindus. It also examines interactions of Islamic education with its Hindu counterpart from Sultani to Nawabi period despite having clear distinctions across (...) the communities in many respects. Analyzing the primary and secondary sources on education of Medieval Bengal, this paper shows how in a religiously polarized society, the Hindus and Muslims interacted in the field of education going beyond the existing hostility, mistrust and prejudices in many aspects of their distinctive life styles. Some authors have proposed that Avicenna considers mathematical objects, i.e., geometric shapes and numbers, to be mental existents completely separated from matter. In this paper, I will show that this description, though not completely wrong, is misleading. Avicenna endorses, I will argue, some sort of literalism, potentialism, and finitism.

The study contributes to building an understanding of the impact of political forces on the information environment of listed firms in a developing economy. Specifically, it investigates the tensions between politico-institutional factors and accounting regulation on the prolonged and incomplete implementation of the International Financial Reporting Standards in Bangladesh from 1998 to 2010. Two phases of interviews were conducted in 2010–2011 and IFRS-related enforcement documents from 1998 to 2010 were evaluated. The study contributes that IFRSs are being diffused to developing (...) countries like Bangladesh, but they invariably interact with local institutions, with variable outcomes. Coercive, normative and mimetic isomorphisms are low in Bangladesh. Notably, political forces have been undermining mimetic isomorphism because of the high level of government intervention and the high level of political lobbying. Political institutional pressures stand in the way of mimetic isomorphism and constitute negative forces that add further tension to accounting regulation in Bangladesh. Regarding the low level of normative isomorphism, there is evidence of a ‘blame culture’, with state institutions and professional accountancy institutions in the country blaming each other for the poor progress in IFRS implementation. Although the study focuses on Bangladesh, its results have implications for international policy makers, as well as the governments and regulators of other developing economies facing similar challenges in implementing IFRS. This work engages in a constructive, yet subtle, dialogue with the nuanced accounts of sensory intentionality and empirical knowledge offered by the Islamic philosopher Avicenna. -/- This discourse has two main objectives: (1) providing an interpretation of Avicenna’s epistemology that avoids reading him as a precursor to British empiricists or as a full-fledged emanatist and (2) bringing light to the importance of Avicenna’s account of experience to relevant contemporary Anglo-American discussions in epistemology and metaphysics. These two objectives are interconnected. Rokeya Sakhawat Hossain (1880–1932) was a pioneering feminist writer, educationist and activist in colonial Bengal, who not only sought to emancipate women from the deeply entrenched values of Indian social and cultural patriarchy through her darkly satirical and provocative writings, but also actively pursued her idea of empowering women through education by setting up a school for Muslim girls. This article will investigate Rokeya’s feminist ideology and her educational programmes undertaken for the betterment of Indian women, especially Bengali Muslim women. (...) I intend to argue that although born into an orthodox family and brought up in strict purdah without any formal education, Rokeya had that rare foresight and courage to challenge the social status quo of her time and ridicule many of the outmoded gender practices in her writings, and even turn gender relations upside down by creating a Ladyland in her utopian narrative Sultana’s Dream ([1905], 1908), in which men are confined to indoors while women run the state. Moreover, she was practical enough to reify her vision by taking steps to eradicate women’s ignorance and invigorate their sense of self, by setting up a school in Calcutta and by running programmes to educate slum women through the association for Muslim women, Anjuman-i-Khwateen-i-Islam, which she founded in 1916—all at a time when Indian Muslim women were expected to live in confinement in the zenana and any attempt to educate them was seen as blasphemous. In this note I discuss some issues around the law of Identity of Indiscernibles and, above all, its difference with the so-called law of indiscernibilty of identicals. In this way I distinguish between the notions identity, sameness and equality, through a phenomenological discussion and using the key idea of intentionality. In order to formulate the Leibnizian law of Identity of Indiscernibles, and examine its validity, we need higher order logic. I will give semantic rules for a second-order logic with identity (...) in the framework of the dialogical logic, introduced by P. Lorenzen. Then I will demonstrate the validity of the law of Identity of Indiscernibles by means of the introduced logic. (shrink)

Retractions solicited by authors following the discovery of an unintentional error—what we henceforth call a “self-retraction”—are a new phenomenon of growing importance, about which very little is known. Here we present results of a small qualitative study aimed at gaining preliminary insights about circumstances, motivations and beliefs that accompanied the experience of a self-retraction. We identified retraction notes that unambiguously reported an honest error and that had been published between the years 2010 and 2015. We limited our sample to retractions (...) with at least one co-author based in the Netherlands, Belgium, United Kingdom, Germany or a Scandinavian country, and we invited these authors to a semi-structured interview. Fourteen authors accepted our invitation. Contrary to our initial assumptions, most of our interviewees had not originally intended to retract their paper. They had contacted the journal to request a correction and the decision to retract had been made by journal editors. All interviewees reported that having to retract their own publication made them concerned for their scientific reputation and career, often causing considerable stress and anxiety. Interviewees also encountered difficulties in communicating with the journal and recalled other procedural issues that had unnecessarily slowed down the process of self-retraction. Intriguingly, however, all interviewees reported how, contrary to their own expectations, the self-retraction had brought no damage to their reputation and in some cases had actually improved it. We also examined the ethical motivations that interviewees ascribed, retrospectively, to their actions and found that such motivations included a combination of moral and prudential considerations. These preliminary results suggest that scientists would welcome innovations to facilitate the process of self-retraction. (shrink)

In recent years, there has been a noticeable increase in organizational trends to hire irregular workers. This inclination, in a time of great flux and uncertainty, exacerbates human resource issues faced by firms. We argue that corporate social responsibility can be an important antecedent to improve the workplace attitudes of irregular workers and as a result reduce the negative impact on organizations of the increased use of an irregular workforce. Hence, we explore the relationship between perceived CSR and unfairness perception (...) and social relations of subcontracted workers with regular workers. We further attempt to explain these relationships through the mediating effects of psychological contract violation and organizational identity, respectively. Our analysis supports a negative effect of composite and external CSR on unfairness perception and positive effect on social relations. Additionally, our results support partial mediating roles of psychological contract violation and organizational identity. Theoretical and practical implications of the results are also discussed.
